Terms of Use

These terms apply to modernstacklabs.com, operated by Modern Stack Labs LLC, a North Carolina limited liability company based in Union County.

By using this site you accept them. If you do not accept them, please do not use the site. Paid work is governed by a separate written agreement, which is explained in section 3.

1. What this site is

Modern Stack Labs is an AI and automation studio. We build websites, automate business workflows, and deploy AI chat and voice agents for small businesses across North Carolina and South Carolina.

This site describes what we do and what it typically costs. It is information about our services, not an offer to provide them on particular terms.

2. Using the site

Use this site lawfully. Do not scrape, mine, reverse-engineer, overload, or interfere with it, do not try to reach parts of it that are not meant to be public, and do not impersonate anyone.

You need to be 18 or older to submit anything through our forms.

3. Prices, proposals, and engagements

We publish real starting prices because you should be able to see what something costs before you talk to a salesperson. Those prices are honest starting points, and they are not quotes.

  • Prices shown on this site are starting points for a typical small business. What you actually pay depends on what you already have in place, what has to be integrated, and how much content is involved.
  • Nothing on this site is an offer, a quote, or a contract. Prices, packages, and availability can change.
  • A price becomes binding only when it is written into a proposal or agreement that we both sign.
  • Submitting the contact form, booking a discovery call, or asking for a quote does not create an engagement or a client relationship. That begins when we both sign.
  • Written proposals are valid for 30 days unless the proposal says otherwise.
  • If we change our published prices, the change does not affect work already agreed or in progress.
  • If anything on this page conflicts with a signed agreement between us, the signed agreement controls.

4. Our content, and work we build for you

Everything on this site — the text, design, graphics, code, and the Modern Stack Labs name and marks — belongs to us. You are welcome to view and share it. You may not copy it for commercial use without our permission.

Work we build for you is a different matter, and we mean what we say about ownership. On full payment you own the custom work we deliver for you, including your site's design and content and the automations we build in your accounts.

Some things we cannot transfer because they were never ours to give: third-party software, plugins, themes, stock media, and fonts stay under their own licences, and our own reusable frameworks and internal tooling are licensed to you rather than assigned. The operative terms are in your signed agreement.

5. What you send us

Please do not send confidential or sensitive information through our contact form. What you do send should be accurate and yours to send.

If you give us feedback, or a testimonial about our work, we may use it in our marketing unless you tell us not to.

6. Demos, examples, and AI output

Demos and examples on this site are illustrative. They show the kind of thing we build. They are not a representation of what any particular business will receive.

AI systems can be wrong. Any chat or voice agent we demonstrate here, and the ones we build for clients, can produce inaccurate, incomplete, or out-of-context answers, and they are designed to work with human oversight rather than without it.

Anything an AI agent tells you about pricing, availability, or scheduling is not binding on us. Section 3 governs price.

7. Not professional advice

Content on this site and on our blog is general information. It is not legal, financial, tax, medical, or other professional advice, and it is not a substitute for talking to a qualified professional about your own situation.

8. No guarantee of results

We do not guarantee particular business outcomes: search rankings, traffic, lead volume, conversion rates, revenue, or uptime.

Anything we say about likely results is an opinion based on experience, not a promise. What we do commit to is in your signed agreement.

9. Services we depend on

Our work runs on services we do not control, including hosting, scheduling, telephony, AI model providers, and automation platforms. Their outages, policy changes, and price changes are outside our control.

Links from this site to other websites are not endorsements, and we are not responsible for what is on them.

10. Disclaimer of warranties

THIS SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow these exclusions, in which case they apply to the fullest extent the law permits.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THIS WEBSITE.

Our total liability for any claim arising out of your use of this website will not exceed $100. This section is about using the website. Our responsibility for paid work is set out in your signed agreement, not here.

12. Indemnification

You agree to indemnify us against claims arising from your misuse of this site, your breach of these terms, or anything unlawful or infringing that you submit through it.

13. Governing law and disputes

North Carolina law governs these terms, without regard to its conflict-of-laws rules.

Before filing anything, please contact us at hello@modernstacklabs.com with a written description of the problem and give us 30 days to put it right. Most things can be sorted out this way.

If that does not resolve it, disputes go to the state or federal courts serving Union County, North Carolina, and we both consent to that venue. Any claim must be brought within one year of when it arose. Nothing here prevents either of us from bringing a matter in small claims court.

14. General

If any provision of these terms turns out to be unenforceable, the rest still applies. If we do not enforce something straight away, that is not a waiver of it.

These terms, together with our privacy policy, are the entire agreement between us about your use of this website. We may update them, and the effective date at the top will change when we do.
